1. Acceptance of Terms
By downloading, accessing, or using the TravelDay mobile application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
TravelDay is a travel safety companion application designed to provide safety alerts, document storage, and trip tools.The Service is for informational purposes only. It is not a security service, emergency dispatcher, or insurance provider.
CRITICAL SAFETY DISCLAIMER
The safety information, alerts, and risk assessments provided by TravelDay are based on publicly available data sources and third-party feeds. We do not guarantee the accuracy, completeness, timeliness, or reliability of any safety information.Reliance on any information provided by TravelDay is solely at your own risk.
The "Emergency Mode" and "Safety Check-in" features are convenience tools. They are NOT a replacement for local emergency services (911/112) or official government communications. In a life-threatening situation, always contact local authorities directly.
3. Accounts and Subscriptions
Registration: You must provide accurate and complete information when creating an account.
Subscriptions: Certain features of the Service are available only with a paid subscription (e.g., Plus, Lifetime). Subscriptions are billed through Apple App Store, Google Play Store, or Stripe, depending on your purchase method.
Renewals & Cancellations: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your device settings or account portal. Refunds are subject to the policies of the platform you purchased from (Apple/Google).
4. User Content
You retain ownership of the documents, trip details, and personal data ("User Content") you upload to the Service. By uploading User Content, you grant us a license to host, store, and display it solely for the purpose of providing the Service to you.
You are responsible for ensuring your User Content does not violate any laws or third-party rights. We reserve the right to remove any content that violates these Terms.
5. AI Features
The Service includes Artificial Intelligence (AI) features. Output from AI is probabilistic and may be inaccurate or misleading. You should verify any AI-generated safety advice or medical information with official sources. We accept no liability for actions taken based on AI responses.
6. Third-Party Links and Services
The Service may contain links to third-party web sites or services (e.g., Viator, Airalo) that are not owned or controlled by TravelDay. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party. You acknowledge and agree that TravelDay shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of any such content, goods, or services.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRAVELDAY, PLAYACTIONSTUDIOS, LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
